Please read these Terms of Service carefully before using the website and services of TrueSouth Solar Technologies("TrueSouth", "we", "our", "us"). These terms govern your access to and use of truesouthsolartech.com and our solar proposal tool. These Terms are written in compliance with applicable Philippine law.

1. Acceptance of terms

By accessing or using the TrueSouth Solar Technologies website (truesouthsolartech.com) and solar proposal tool, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access or use our services.

2. Description of service

2.1 Solar proposal tool

TrueSouth Solar Technologies provides a free AI-powered solar proposal tool that generates personalised solar installation proposals for Philippine residential properties. The service includes collecting your electricity usage data, running a physics-based solar simulation, and delivering a PDF proposal with system options and financial projections.

2.2 Informational content

Our website provides educational content about solar energy, net metering, and related topics. This content is provided for general informational purposes only and does not constitute professional engineering, financial, or legal advice.

2.3 No obligation

Requesting a solar proposal through our tool creates no obligation on your part to proceed with an installation, and no obligation on TrueSouth's part to provide installation services. The proposal is a preliminary estimate only.

3. Proposal accuracy and limitations

3.1 Estimates, not guarantees

The solar proposals generated by our tool are estimates based on the information you provide, NASA satellite weather data, live Meralco rates, and engineering models. They are not guaranteed outcomes. Actual system performance, savings, and payback period will vary based on your specific roof characteristics, shading, consumption patterns, Meralco rate changes, and other factors.

3.2 Accuracy range

Our proposals are typically accurate to within 10–15% of the final engineered quote for most homes. A site survey by our licensed engineers is required before a final, binding installation proposal can be issued.

3.3 Financial projections

The 25-year financial projections in your proposal are based on assumed constants including a 5% annual Meralco rate escalation, 0.5% annual panel degradation, and a ₱6.00/kWh net metering buyback rate. These assumptions reflect historical data and regulatory rates but are not guaranteed. Actual future rates and conditions may differ.

3.4 No professional advice

Nothing in your solar proposal constitutes financial, investment, or engineering advice. You should consult with a qualified professional before making any significant financial decision based on your proposal.

4. Your responsibilities

4.1 Accurate information

You agree to provide accurate and complete information when using our solar proposal tool. Providing false or misleading information — including incorrect addresses, fabricated bill amounts, or bill images not belonging to your property — may result in a proposal that is not useful and may affect our ability to serve you.

4.2 Authorised use

You may only request a proposal for a property for which you have ownership or authorised decision-making rights. You may not use our service to generate proposals for properties on behalf of others without their knowledge and consent.

4.3 Lawful use

You agree to use our website and services only for lawful purposes and in accordance with these Terms. You agree not to use our services in any way that violates applicable Philippine law or regulation.

5. Intellectual property

5.1 Our content

All content on our website — including text, graphics, logos, the solar proposal PDF format, and software — is the property of TrueSouth Solar Technologies and is protected by Philippine intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

5.2 Your proposal

The solar proposal PDF generated for you is provided for your personal use in evaluating a solar installation for your property. You may share it with family members, financial advisors, or other parties involved in your decision. You may not resell, publicly distribute, or misrepresent it as originating from another source.

5.3 Feedback

If you provide feedback, suggestions, or ideas about our service, you grant us a non-exclusive, royalty-free licence to use that feedback to improve our services without any obligation to you.

6. Third-party services

Our service uses third-party APIs and services including NASA POWER (weather data), Google Gemini (AI processing), OpenAI GPT-4o (AI processing), Groq (AI processing), and Resend (email delivery). Your use of our service is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the practices of these third parties.

7. Limitation of liability

7.1 No warranty

Our website and solar proposal tool are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 Limitation of damages

To the maximum extent permitted by Philippine law, TrueSouth Solar Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or reliance on our solar proposals, even if we have been advised of the possibility of such damages.

7.3 Maximum liability

Our total liability to you for any claim arising from your use of our free proposal service shall not exceed ₱5,000. This limitation does not apply to liability arising from actual installation services, which are governed by a separate installation agreement.

8. Installation services

If you proceed with a solar installation with TrueSouth Solar Technologies, the installation will be governed by a separate Installation Agreement that you will sign prior to commencement of work. That agreement will supersede these Terms with respect to the installation services and will contain specific warranties, payment terms, and dispute resolution procedures.

9. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

10. Governing law and disputes

10.1 Governing law

These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Metro Manila, Philippines.

10.2 Informal resolution

Before filing any formal legal claim, you agree to first contact us at legal@truesouthsolartech.com and provide a written description of the dispute. We will make a good-faith effort to resolve the dispute informally within 30 days.

11. Changes to these terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
